The Background Investigator Goes To Manhattan
In a continuing series, The Background Investigator, is sending its attorneys to various countries around the world to explore the justice systems and bring back to you their findings. This month Fred Frankel visited New York City. Here is his report:

by Fred Frankel, Esq.

  1. The Kings County Supreme Court

Our goal was to obtain Certificate of Dispositions. We went to the 12th Floor and ordered the certificate of disposition.
They looked up the name based upon us saying there was a case. They made it clear to us to find out if there is case we needed to go to OCA.
The files are stored next door and they would give us a file if we had the docket number.
There is no docket book for public viewing.
The case files there are only from 2003.
The ones from 1998 to 1003 are across the street and have to be ordered. Older cases are in archive.

  2. The Kings County Criminal Court

We went into the clerk's office where they looked up the docket number.
At another counter window you got the certificate of disposition.
They made it clear that if we did not know of a case we needed to use the OCA.
The line at the Certificate of Disposition window was extremely long, probably because court had just let out.
Here (at Criminal Court) the clerks were a lot friendlier (than the Supreme Court).
With both courts, they gave me their addresses in case I wanted to request in writing a certificate of disposition.

  3. New York County Supreme Court

The office is on the 13th Floor.
The story was the same here - they looked up the name but said if we are not sure about there being a case we needed to go through the OCA.
When we asked about docket books, they explained that there is no public access because there are cases on the books which are sealed - so we cannot just look through them.
